DIRECTIONS

for the submission of applications for renewal of a Community licence to carry out carriage of passengers or goods and for the receipt of licences issued

For the renewal of a Community licence to carry out the carriage of passengers or goods, road hauliers shall submit an application to the Minister for Transport, Information Technology and Communications. The application shall be in the form of a specimen and shall be submitted through the head of the relevant regional department for control activities - SAI of the trader's registration.

The application shall be accompanied by the following documents:

1. current certificate of registration in the commercial register - the document shall be submitted if the trader has not been registered or re-registered after 1 January 2008;

2. declaration that the trader is not in bankruptcy proceedings - the document shall be submitted if the trading company has not been registered or re-registered after 1 January 2008;

3. a copy of the certificate of registration in the BULSTAT register - the document shall be submitted if the trader has not been registered or re-registered after 1 January 2008.

4. financial stability documents certifying the availability of the necessary resources for the normal operation of the business;

5. a criminal record of the person in charge of the transport activity;

6. a copy of the certificate of professional competence issued to the person in charge of the transport activity - to be submitted when the certificate is not issued by the Executive Agency "Road Administration" but by a competent authority of another Member State of the European Union";

7. a declaration of the existence of a garage area, either owned or rented, with a precise address;

8. a copy of the contract of appointment of the person in charge of the transport activity;

9. a copy of the statement of accepted and rejected notifications under Article 62(4) of the Labour Code for the person appointed to manage the transport activity;

10. a declaration of compliance with the requirement for establishment on the territory of the Republic of Bulgaria.

Carriers shall declare the existence of their own or rented garage space and their compliance with the requirement for establishment in the territory of the Republic of Bulgaria by means of a single declaration in the form of

Carriers shall submit a statement of financial stability in a form.

Carriers whose annual financial statements are subject to a statutory independent financial audit pursuant to Art. 38, par. 1 of the Accounting Act, shall submit the annual financial statements of the company for the last reporting period, certified by a registered auditor, and a certificate of absence of liabilities under Article 87, paragraph 6 of the Tax and Social Insurance Procedure Code.

Carriers whose annual financial statements are not subject to subject to a statutory independent financial audit pursuant to Art. 38 para. 1 of the Accounting Act, shall submit optionally the undertaking's annual accounts for the last accounting period, certified by a registered auditor, and/or a bank guarantee, and/or insurance and a certificate of absence of liabilities pursuant to Article 87(6) of the Tax and Social Security Procedural Code.

Where the carrier proves its financial soundness by means of the annual accounts of the undertaking certified by a registered auditor and the amount of its own funds is less than that provided for in Article 7(1) of Regulation No 1071/2009, it shall, in addition to the annual accounts, provide an insurance contract or a bank guarantee. In that case, the insurance contract or bank guarantee may be concluded for the amount of the carrier's own funds which are insufficient to prove its financial standing.

The insurance contract must meet the following requirements:

1. be concluded for insurance under Section II, letter "A", items 3, 8, 9, 13 and 16 of Annex No. 1;

2. be taken out for an amount of insurance not less than the total amount of equity capital required to be held by the carrier under par. 1;

3. the period of insurance cover must be 1 year.

The bank guarantee must meet the following requirements

1. be in favour of the carrier;

2. have a term of not less than one year;

3. cannot be changed or cancelled without prior notification to the Executive Agency "Automobile Administration";

4. be issued by a local bank holding a banking licence issued by the Bulgarian National Bank under the terms and conditions of the Credit Institutions Act, or by a bank authorised to carry out banking activities by a competent authority of a Member State of the European Union.

The fee for renewal of the Community licence, provided for in Tariff No 5 on the fees to be collected in the system of the Ministry of Transport, Information Technology and Communications, approved by Decree No 81 of the Council of Ministers of 2000, is BGN 100, for issuing a certified copy of the Community licence - BGN 10.

Proof of payment of the fee shall be produced on receipt of the licence issued and the certified copies thereof.
